About Equipment Manager
Equipment Manager is a subscription-based software service provided by Yotta Information Systems (Pty) Ltd ("Yotta", "we", "us", "our"). These Terms and Conditions govern your use of the Equipment Manager platform.
By creating an account or using Equipment Manager, you agree to these terms.
1. Service Description
Equipment Manager provides web-based software for:
- Equipment and asset tracking and management
- Maintenance scheduling and records
- Location and assignment tracking
- Reporting and analytics
- User access controls and permissions
2. Eligibility and Account Creation
Who May Use Equipment Manager
- Businesses and organisations requiring equipment management
- Individuals acting on behalf of their employer or business
- Users must be 18 years or older
- Users must provide accurate registration information
Account Security
- You are responsible for maintaining your account security
- Keep your login credentials confidential
- Notify us immediately of any unauthorised access
- You are liable for all activities under your account
3. Subscription Plans and Billing

- We may modify plans and pricing with reasonable notice
Free Trials
- Free trials are available for evaluation purposes
- Trial limitations and duration are specified during signup
- Trials convert to paid subscriptions unless cancelled

7. Service Availability and Support
Service Level

- Scheduled maintenance will be announced in advance
- We do not guarantee 100% uptime due to factors beyond our control
Support
- Support is provided via email and online help resources
- Support level depends on your subscription plan
- We aim to respond to support requests within reasonable timeframes
Platform Updates
- We regularly update Equipment Manager with improvements and new features
- Updates are included in your subscription
- We may occasionally require temporary service interruptions for updates
8. Privacy and Security
Your privacy is important to us. Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these terms.
9. Limitation of Liability
Service Limitations
- Equipment Manager is provided "as is" without warranties
- We disclaim warranties of merchantability, fitness for purpose, and non-infringement
- Your use of the service is at your own risk
Liability Limits
- Our liability to you is limited to the fees you paid in the 12 months before the claim
- We are not liable for indirect, consequential, or punitive damages
- We are not liable for business losses, lost profits, or lost data beyond our direct control
- These limitations apply to the fullest extent permitted by South African law
10. Termination and Suspension
Termination by You
- You may terminate your account at any time
- Provide reasonable notice for large accounts requiring data migration assistance
- You remain liable for charges incurred before termination
Termination by Us
We may suspend or terminate your account if you:
- Breach these terms and conditions
- Engage in prohibited activities
- Fail to pay subscription fees
- Use the service in ways that harm our business or other users
Effect of Termination
- Your access to Equipment Manager will cease
- We will retain your data for 30 days to allow export
- After 30 days, your data will be permanently deleted
- Termination does not relieve you of outstanding payment obligations
11. Changes to Terms
We may modify these Terms and Conditions from time to time. We will:
- Provide reasonable notice of material changes
- Notify you via email or through the Equipment Manager platform
- Allow you to terminate if you disagree with changes
- Continue operating under previous terms until you accept changes or terminate
12. Governing Law and Disputes
Jurisdiction
- These terms are governed by the laws of the Republic of South Africa
- Any disputes will be resolved in South African courts
- You consent to the jurisdiction of South African courts
Dispute Resolution
- We prefer to resolve disputes informally where possible

13. General Provisions
Entire Agreement
These Terms and Conditions, together with our Privacy Policy, constitute the complete agreement between you and Yotta regarding Equipment Manager.
Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions continue in effect.
Assignment
We may assign these terms or our rights to a successor entity. You may not assign your account or obligations without our consent.
